You may also contact your<a href=\"https:\/\/research.ncsu.edu\/administration\/contact\/college-unit-research-contacts\/\"> College Research Office<\/a> (CRO) to discuss possible exceptions that require additional approvals.<\/p>\n\n\n  <\/div>\n\n\n<div class=\"wp-block-ncst-fp-accompaniment\">\n    \n<aside class=\"floated-spotlight-aside-container\">\n  <div class=\"floated-spotlight-contents\">\n    <div class=\"ncst-content-card wp-block-ncst-fp-spotlight-card has-gray-800-background-color\">\n  \n    \n    <div class=\"content-card__text-container\">\n      \n                        <h3 class=\"content-card__headline\">PI Responsibilities<\/h3>\n              \n\n              \n\t      \t        <p class=\"content-card__teaser\">It is the responsibility of the Principal Investigator (PI) to ensure that the DUA is fully executed before gaining access to protected data for use in research activities. <\/p>\n\t      \t    \n          <\/div>\n\n  <\/div>\n  <\/div>\n<\/aside>\n\n\n  <\/div>\n\n\n    <\/div>\n  \n\n\n\n<div style=\"height:5px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n<div class=\"is-text wp-block-ncst-accordion\" >\n    <div class=\"accordion isLinked\" id=\"ncst-accordion-actzqt\">\n          \n<details class=\"wp-block-ncst-accordion-item\" name=\"actzqt\"  >\n      <summary class=\"accordion-item__header\">\n        <span class=\"accordion-item__expansion-indicator\">\n          <span class=\"ncst-plus-minus-toggle\"><\/span>\n        <\/span>\n        <h2 class=\"accordion-item__label h6\">Who may sign a DUA?<\/h2>\n      <\/summary>\n      <p>\n        \n\n<p>Only an authorized signatory of North Carolina State University may approve terms and conditions and sign agreements on behalf of the University and its researchers, whether such agreements signed electronically or otherwise.&nbsp; Authorized signatories are delegated under<a href=\"https:\/\/policies.ncsu.edu\/regulation\/reg-01-20-02\/\" target=\"_blank\" rel=\"noreferrer noopener\"> REG 01.20.02<\/a> and listed<a href=\"https:\/\/research.ncsu.edu\/administration\/proposals\/signatory\/\"> here<\/a>. Faculty members, students, or other individual data users are not authorized to sign Data Use Agreements on behalf of North Carolina State University and should seek assistance from their College Research Office to properly route such agreements to SPARCS for review and signature.<\/p>\n\n\n\n<p>PIs must also retain a copy of the fully executed DUA with their research records as dictated by<a href=\"https:\/\/policies.ncsu.edu\/regulation\/reg-01-25-12\/\" target=\"_blank\" rel=\"noreferrer noopener\"> REG 01.25.12<\/a>, and in accordance with any other retention requirements indicated by the data provider or funding agency agreement(s).<\/p>\n\n\n      <\/p>\n  <\/details>\n\n\n<details class=\"wp-block-ncst-accordion-item\" name=\"actzqt\"  >\n      <summary class=\"accordion-item__header\">\n        <span class=\"accordion-item__expansion-indicator\">\n          <span class=\"ncst-plus-minus-toggle\"><\/span>\n        <\/span>\n        <h2 class=\"accordion-item__label h6\">How do I request a review of a DUA or obtain approval to access a Data Set?<\/h2>\n      <\/summary>\n      <p>\n        \n\n<p>If you are in receipt of a Data Use Agreement or intend to seek access to a protected dataset, you should work with your <a href=\"https:\/\/research.ncsu.edu\/administration\/contact\/college-unit-research-contacts\/\">College Research Office<\/a> to route a Data Use Agreement-type proposal record through PINS or RED PD. Once you\u2019ve worked with your College Research Office, you will complete this <a href=\"https:\/\/docs.google.com\/document\/d\/1NOtfHHDdwzdtBx8jU7OE4HIvsZMHRBu_2QuGk29rOQw\/edit#\" target=\"_blank\" rel=\"noreferrer noopener\">Data Use Agreement Intake and Request Form<\/a>, and submit it along with relevant information and other documentation as described below. This will provide SPARCS with the initial information needed to assist with processing your Data Use Agreement.\u00a0 General questions may be submitted to the appropriate College Research Office.<\/p>\n\n\n      <\/p>\n  <\/details>\n\n\n<details class=\"wp-block-ncst-accordion-item\" name=\"actzqt\"  >\n      <summary class=\"accordion-item__header\">\n        <span class=\"accordion-item__expansion-indicator\">\n          <span class=\"ncst-plus-minus-toggle\"><\/span>\n        <\/span>\n        <h2 class=\"accordion-item__label h6\">Proposal Records (PD\/PINS) Guidance<\/h2>\n      <\/summary>\n      <p>\n        \n\n<p>RED Proposal Development (PD) and PINS are the electronic systems currently used to track proposal data and to verify approvals from all faculty and administrators involved in submitting a particular proposal. Rollout of the PD system is ongoing, and will be completed in 2026.\u00a0The use of PD or PINS is a required part of the submission process for all proposals submitted by all NC State faculty, including Data Use Agreements.<\/p>\n\n\n\n<p>When routing a PD or PINS record for a new Data Use Agreement, please include the following information, as applicable:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Title convention: \u201cData Use Agreement with [Company Name]\u201d<\/li>\n\n\n\n<li>Complete the \u2018Associated RADAR Project ID\u2019 field in PINS, or link the PD record to<\/li>\n\n\n\n<li>the appropriate existing project record, if applicable<\/li>\n\n\n\n<li>TotalAmount Requested: $0<\/li>\n\n\n\n<li>F&amp;A Rate: 52%<\/li>\n\n\n\n<li>F&amp;A Basis: MTDC <\/li>\n\n\n\n<li>Justification for Underrecovery: F&amp;A Fully Recovered<\/li>\n\n\n\n<li>Provide sponsor point-of-contact information: name and title, email address, and phone number, at a minimum.<\/li>\n\n\n\n<li>Documentation: DUA Agreement, Description of Project (if not included in the agreement), Data Management Plan (if required), and DUA Intake Form.<\/li>\n<\/ul>\n\n\n\n<p>The agreement and proposal record will be reviewed by SPARCS to determine the next steps needed to agree to the terms and conditions on behalf of NC State.<\/p>\n\n\n\n<p>These steps may include but are not limited to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Negotiations to request changes to language in the agreement<\/li>\n\n\n\n<li>Data Security Review<\/li>\n\n\n\n<li>Acceptance of higher risk terms and conditions by department or college leadership<\/li>\n<\/ul>\n\n\n      <\/p>\n  <\/details>\n\n\n<details class=\"wp-block-ncst-accordion-item\" name=\"actzqt\"  >\n      <summary class=\"accordion-item__header\">\n        <span class=\"accordion-item__expansion-indicator\">\n          <span class=\"ncst-plus-minus-toggle\"><\/span>\n        <\/span>\n        <h2 class=\"accordion-item__label h6\"><strong>When will a Data Access and Security Plan be required for DUAs?<\/strong><\/h2>\n      <\/summary>\n      <p>\n        \n\n<p><a href=\"https:\/\/drive.google.com\/file\/d\/17vi6gPC1f_34eSW7X7_miLyh0VHIdJX5\/view\" target=\"_blank\" rel=\"noreferrer noopener\">Data Access and Security Plans<\/a> may be required for regulated data, such as Human Subject information or Export Controlled data, or when the Data provider requires one.\u00a0 The <a href=\"https:\/\/docs.google.com\/document\/d\/1NOtfHHDdwzdtBx8jU7OE4HIvsZMHRBu_2QuGk29rOQw\/edit#\" target=\"_blank\" rel=\"noreferrer noopener\">DUA intake form<\/a> is intended to help SPARCS identify those circumstances. If the requester has developed a DASP, that can be included in the proposal record, but is not required.<\/p>\n\n\n      <\/p>\n  <\/details>\n\n\n<details class=\"wp-block-ncst-accordion-item\" name=\"actzqt\"  >\n      <summary class=\"accordion-item__header\">\n        <span class=\"accordion-item__expansion-indicator\">\n          <span class=\"ncst-plus-minus-toggle\"><\/span>\n        <\/span>\n        <h2 class=\"accordion-item__label h6\">Do I need IRB approval for the use of Data that is covered under a DUA?<\/h2>\n      <\/summary>\n      <p>\n        \n\n<p>Depending on the specific data and the requirements set forth in the DUA,&nbsp;IRB review and approval or a specific determination may be needed. The&nbsp;IRB outlines&nbsp;<a href=\"https:\/\/research.ncsu.edu\/administration\/compliance\/research-compliance\/irb\/irb-procedures-and-guidance\/\" target=\"_blank\" rel=\"noreferrer noopener\">requirements<\/a>&nbsp;for the secondary use of human subjects&#8217; data on their website. Reasons IRB approval for the use of human subjects\u2019 data that is covered under a DUA could include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If the data are obtained for research purposes and are considered private and individually identifiable or easily re-identifiable to the research team.<\/li>\n\n\n\n<li>A data provider may require IRB review\/approval&nbsp;or may require an official determination from the IRB that a project is &#8220;not human subjects research (NHSR)&#8221;&nbsp;before they will share the data.<\/li>\n\n\n\n<li>Some data providers will require IRB approval as a part of the DUA even if the NC State IRB determines that no IRB approval is required. In these cases, the NC State IRB will support the researcher and review the project as required by the data provider.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>If IRB review and approval are required,&nbsp;a copy of the DUA&nbsp;must be provided to the NC State IRB for review with the proposed IRB protocol.&nbsp;Any provisions for data&nbsp;access, security, sharing, or disposition of the data&nbsp;as detailed in the DUA must be congruent with the study procedures submitted to the IRB for all associated study protocols and documents.&nbsp;<\/p>\n\n\n\n<p>The IRB can review and approve a study with a draft DUA to keep administrative processes moving. However, when the DUA is fully executed, the executed DUA (and any resulting updated study procedures)&nbsp;must be submitted to the IRB via an amendment for review and approval before any data are exchanged. To request a Data Access and Security Plan for an associated IRB protocol, please use your unity ID credentials to login to the \u201c<a href=\"https:\/\/ncsu.service-now.com\/sp?id=sc_cat_item&amp;sys_id=eb9cb46f1bb5d91039f40ed6624bcb8c\">IT Service Portal<\/a>\u201d to initiate the process.&nbsp;<\/p>\n\n\n\n<p>In some cases, the IRB will require a \u201cData Access and Security Plan to be submitted with the IRB protocol associated with a DUA. Refer to the section above.<\/p>\n\n\n      <\/p>\n  <\/details>\n\n\n<details class=\"wp-block-ncst-accordion-item\" name=\"actzqt\"  >\n      <summary class=\"accordion-item__header\">\n        <span class=\"accordion-item__expansion-indicator\">\n          <span class=\"ncst-plus-minus-toggle\"><\/span>\n        <\/span>\n        <h2 class=\"accordion-item__label h6\">Who is permitted to access the Data received under a Data Use Agreement?<\/h2>\n      <\/summary>\n      <p>\n        \n\n<p>Data Use Agreements may specify only named project personnel as authorized to access data under the terms and conditions of the agreement. However, if the agreement does not require specifically named individuals, only North Carolina State University employees are authorized to access the data.\u00a0Additional <a href=\"https:\/\/policies.ncsu.edu\/regulation\/reg-08-00-03\/\" target=\"_blank\" rel=\"noreferrer noopener\">data security<\/a> requirements should be taken into consideration, if applicable.<\/p>\n\n\n\n<p>The PI is accountable for all project personnel who will have access to the data.<\/p>\n\n\n      <\/p>\n  <\/details>\n\n\n<details class=\"wp-block-ncst-accordion-item\" name=\"actzqt\"  >\n      <summary class=\"accordion-item__header\">\n        <span class=\"accordion-item__expansion-indicator\">\n          <span class=\"ncst-plus-minus-toggle\"><\/span>\n        <\/span>\n        <h2 class=\"accordion-item__label h6\"><strong>Students and Data Use Agreements<\/strong><\/h2>\n      <\/summary>\n      <p>\n        \n\n<p>If you would like to allow an unpaid student (undergraduate and graduate student) access to data received under a Data Use Agreement, please contact SPARCS prior to allowing access.<\/p>\n\n\n\n<p>Generally speaking, students who are not graduate students on a research assistantship conducting University research will need to be independently bound to terms and conditions contained in any Data Use Agreement, including obligations of confidentiality and non-redistribution.<\/p>\n\n\n      <\/p>\n  <\/details>\n\n\n<details class=\"wp-block-ncst-accordion-item\" name=\"actzqt\"  >\n      <summary class=\"accordion-item__header\">\n        <span class=\"accordion-item__expansion-indicator\">\n          <span class=\"ncst-plus-minus-toggle\"><\/span>\n        <\/span>\n        <h2 class=\"accordion-item__label h6\"><strong>Export Controlled Material<\/strong><\/h2>\n      <\/summary>\n      <p>\n        \n\n<p>Under U.S. export control laws, a license may be required from the Bureau of Industry and Security of the Department of Commerce for the export of certain data. Anyone who is planning to transfer controlled material by the Department of Commerce or the Department of State outside of the United States should work with the NC State <a href=\"https:\/\/research.ncsu.edu\/administration\/compliance\/research-compliance\/export-controls\/\">Export Control Office<\/a> for assistance in seeking any required license. These &#8220;institutional&#8221; DUAs may be in addition to &#8220;transactional&#8221; (&#8220;project-specific&#8221;) DUAs, or in lieu of them.&nbsp; Because of their broader institutional nature, SPARCS handles them differently than transactional DUAs.&nbsp; If you have a requirement for an institutional DUA, please contact the SPARCS Operations Team at&nbsp;<a rel=\"noreferrer noopener\" href=\"mailto:sps@ncsu.edu\" target=\"_blank\">sps@ncsu.edu<\/a>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Existing Institutional DUAs and Registrations&nbsp;<\/h3>\n\n\n\n<p>Some repositories, such as the NIH database of Genotypes and Phenotypes (dbGaP) Data Access, require online registrations.
