The loss of technology, particularly military technology, is a threat to national security. However, even the loss of non-military technologies can impact U.S. economic security.<br><br>Participating in a foreign talent recruitment program (FTRP) is not illegal. However, some programs require participation in activities that create unmanageable <a href=\"https:\/\/research.ncsu.edu\/administration\/compliance\/research-compliance\/coi\/\">conflicts of interest and \/ or commitment<\/a>. Some activities are unethical or even illegal. These types of talent recruitment programs are of the most concern and are considered to be \u201cmalign foreign talent recruitment programs\u201d (MFTRPs).<\/p>\n\n\n\n<p>NC State defines an FTRP<strong> <\/strong>as &nbsp;\u201can effort organized, managed, or funded by a foreign government, or a foreign government instrumentality or entity, to recruit science and technology professionals or students (regardless of full-\/part-time status, citizenship, or national origin) or as may be defined by an applicable government or funding agency.\u201d (<a href=\"https:\/\/policies.ncsu.edu\/regulation\/reg-01-25-01\/\" target=\"_blank\" rel=\"noreferrer noopener\">REG 01.25.01<\/a>, section 3.11). Note: This would include government-sponsored fellowships and scholarships.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Disclosure Requirements<\/h2>\n\n\n<div class=\"is-text wp-block-ncst-accordion\" >\n    <div class=\"accordion isLinked\" id=\"ncst-accordion-tdy398\">\n          \n<details class=\"wp-block-ncst-accordion-item\" name=\"tdy398\"  >\n      <summary class=\"accordion-item__header\">\n        <span class=\"accordion-item__expansion-indicator\">\n          <span class=\"ncst-plus-minus-toggle\"><\/span>\n        <\/span>\n        <h2 class=\"accordion-item__label h6\">Disclosure Obligations to NC State<\/h2>\n      <\/summary>\n      <p>\n        \n\n<p>NC State\u2019s <a href=\"https:\/\/policies.ncsu.edu\/regulation\/reg-01-25-01\/\">REG 01.25.01 \u2013 Conflicts of Interest and Conflicts of Commitment<\/a> requires that covered employees disclose the intention to participate in an FTRP prior to participation.&nbsp;This is done by submitting an External Professional Activities (EPA) Disclosure (previously known as NOI).<\/p>\n\n\n      <\/p>\n  <\/details>\n\n\n<details class=\"wp-block-ncst-accordion-item\" name=\"tdy398\"  >\n      <summary class=\"accordion-item__header\">\n        <span class=\"accordion-item__expansion-indicator\">\n          <span class=\"ncst-plus-minus-toggle\"><\/span>\n        <\/span>\n        <h2 class=\"accordion-item__label h6\">Disclosure Requirements for Federal Research<\/h2>\n      <\/summary>\n      <p>\n        \n\n<p>Federal agencies may also require disclosure of participation in FTRPs, especially if the participation includes conducting research.&nbsp;See <a href=\"https:\/\/research.ncsu.edu\/administration\/proposals\/federal-disclosures\/\">Disclosures in Federal Agency Forms | Research Administration and Compliance<\/a> for more agency-specific guidance.&nbsp;&nbsp;<\/p>\n\n\n      <\/p>\n  <\/details>\n\n\n<details class=\"wp-block-ncst-accordion-item\" name=\"tdy398\"  >\n      <summary class=\"accordion-item__header\">\n        <span class=\"accordion-item__expansion-indicator\">\n          <span class=\"ncst-plus-minus-toggle\"><\/span>\n        <\/span>\n        <h2 class=\"accordion-item__label h6\"><strong>USDA Specific Disclosure Requirements<\/strong>\u00a0<\/h2>\n      <\/summary>\n      <p>\n        \n\n<p>The USDA prohibits Investigators and other Senior Personnel who have participated in Malign Foreign Talent Recruitment Programs in the past 10 years from participating in USDA funded research projects.\u00a0 To be deemed eligible to serve in this capacity on USDA projects, USDA funded Senior Personnel should complete the\u00a0<a href=\"https:\/\/forms.gle\/uXBep5Pa52yuMshQ8\" target=\"_blank\" rel=\"noreferrer noopener\">USDA MFTRP Disclosure Form<\/a>.\u00a0 The Research Security Office will review your disclosure form and determine your USDA eligibility, which will be noted in RED.<\/p>\n\n\n      <\/p>\n  <\/details>\n\n\n    <\/div>\n  <\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Prohibition<\/h2>\n\n\n\n<p>The <a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/house-bill\/4346\/text\">CHIPS and Science Act of 2022<\/a> prohibits federal employees, contractors, and awardees, including institutions, individual investigators, and other key personnel, from participating in MFTRPs. Covered Individuals subject to NC State\u2019s <a href=\"https:\/\/policies.ncsu.edu\/regulation\/reg-01-25-01\/\">REG 01.25.01 \u2013 Conflicts of Interest and Conflicts of Commitment<\/a> are also prohibited from participating in MFTRPs (specifically section 5.2.B.2).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is a Malign Foreign Talent Recruitment Program (MFTRP)?<\/h2>\n\n\n\n<p>NC State defines MFTRP as a Foreign Talent Recruitment Program that is:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>sponsored by, affiliated with, or based in a <a href=\"https:\/\/research.ncsu.edu\/administration\/compliance\/research-compliance\/research-compliance-definitions\/#concern\" target=\"_blank\" rel=\"noreferrer noopener\">Foreign Country of Concern<\/a> or sponsored by an <a href=\"https:\/\/research.ncsu.edu\/administration\/compliance\/research-compliance\/research-compliance-definitions\/#entity\" target=\"_blank\" rel=\"noreferrer noopener\">Entity of Concern<\/a> and&nbsp;<\/li>\n\n\n\n<li>requires the Covered Individual to engage in activities that violate their obligations to NC State or to an applicable research sponsor, creating an unmanageable Conflict of Commitment.<\/li>\n<\/ul>\n\n\n<div class=\"is-text wp-block-ncst-buttons\">\n    \n<div class=\"is-style-secondary wp-block-ncst-button\">\n      <a\n        class=\"ncst-block__button-link btn\"\n        href=\"https:\/\/research.ncsu.edu\/administration\/compliance\/research-compliance\/research-compliance-definitions\/#mftrp\"\n        data-ncst-lightbox=\"false\"\n                      >\n                  <span class=\"text\">Full MFTRP Definition<\/span><span class=\"arrow-indicator\"><svg class=\"wolficon wolficon-arrow-right-bold\" role=\"img\"  aria-hidden=\"true\">\n\t\t\t\n\t\t\t<use xlink:href=\"#wolficon-arrow-right-bold\">\n\t\t<\/svg><\/span>\n              <\/a>\n    <\/div>\n  \n\n  <\/div>\n\n\n<div class=\"is-text wp-block-ncst-accordion\" >\n    <div class=\"accordion isLinked\" id=\"ncst-accordion-zd9ron\">\n          \n<details class=\"wp-block-ncst-accordion-item\" name=\"zd9ron\"  >\n      <summary class=\"accordion-item__header\">\n        <span class=\"accordion-item__expansion-indicator\">\n          <span class=\"ncst-plus-minus-toggle\"><\/span>\n        <\/span>\n        <h2 class=\"accordion-item__label h6\">Programs Sponsored by &#8220;Foreign Countries of Concern&#8221;<\/h2>\n      <\/summary>\n      <p>\n        \n\n<p>Talent recruitment programs sponsored by or located in any country deemed a \u201c<a href=\"https:\/\/research.ncsu.edu\/administration\/compliance\/research-compliance\/research-compliance-definitions\/#concern\">foreign country of concern<\/a>\u201d by the U.S. government is an MFTRP. Currently, that includes:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The People\u2019s Republic of China\n<ul class=\"wp-block-list\">\n<li>This includes Hong Kong and Macau<\/li>\n\n\n\n<li>This does not include Taiwan (The Republic of China)<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>North Korea<\/li>\n\n\n\n<li>Russia<\/li>\n\n\n\n<li>Iran&nbsp;<\/li>\n<\/ul>\n\n\n\n<p><strong>Note<\/strong>: Some federal agencies, such as the Department of Energy, may consider any FTRP associated with one of these Foreign Countries of Concern as high risk and may prohibit participation for those individuals they fund.<\/p>\n\n\n      <\/p>\n  <\/details>\n\n\n<details class=\"wp-block-ncst-accordion-item\" name=\"zd9ron\"  >\n      <summary class=\"accordion-item__header\">\n        <span class=\"accordion-item__expansion-indicator\">\n          <span class=\"ncst-plus-minus-toggle\"><\/span>\n        <\/span>\n        <h2 class=\"accordion-item__label h6\">Malign Attributes<\/h2>\n      <\/summary>\n      <p>\n        \n\n<p>Any program sponsored by the countries of concern that offers you any of the types of compensation in the \u201cCompensation\u201d section for performing one or more activities in the \u201cProblematic Obligations or Activities\u201d section is an MFTRP per the CHIPS and Science Act of 2022. &nbsp;Note that the sponsorship can be directly from a government entity or on behalf of that government.&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Compensation<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Cash&nbsp;<\/li>\n\n\n\n<li>In-kind compensation, including research funding&nbsp;<\/li>\n\n\n\n<li>Promise of future compensation&nbsp;<\/li>\n\n\n\n<li>Complimentary foreign travel&nbsp;<\/li>\n\n\n\n<li>Things of non de minimis value&nbsp;<\/li>\n\n\n\n<li>Honori\ufb01c titles&nbsp;<\/li>\n\n\n\n<li>Career advancement opportunities&nbsp;<\/li>\n\n\n\n<li>Other types of remuneration or consideration&nbsp;<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Problematic Obligations or Activities&nbsp;<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Unauthorized transfer of intellectual property, materials, data, or other nonpublic information.&nbsp;<\/li>\n\n\n\n<li>Recruitment of trainees or researchers to enroll in such program, position, or activity.&nbsp;<\/li>\n\n\n\n<li>Establishing a lab or forming a company in a foreign country in violation of terms and conditions of a federal research award&nbsp;<\/li>\n\n\n\n<li>Accepting a faculty position or undertaking any other employment or appointment in violation of the terms and conditions of a federal research award&nbsp;&nbsp;<\/li>\n\n\n\n<li>Signing a contract or agreement which you are unable to terminate except in extraordinary circumstances.&nbsp;<\/li>\n\n\n\n<li>Committing a specified amount of time to work for the foreign institution.&nbsp;<\/li>\n\n\n\n<li>Engaging in work that overlaps or duplicates a federal research award.&nbsp;<\/li>\n\n\n\n<li>Applying for or receiving research funding from the foreign government that would be awarded to the foreign institution.&nbsp;<\/li>\n\n\n\n<li>Requirement to omit acknowledgement of the foreign institution, or any U.S. federal research sponsors.&nbsp;<\/li>\n\n\n\n<li>Requirement to not disclose participation in the program, position, or activity to NC State or the U.S. federal government.&nbsp;<\/li>\n\n\n\n<li>Having a conflict of interest or commitment contrary to a federal research award.&nbsp;<\/li>\n<\/ul>\n\n\n      <\/p>\n  <\/details>\n\n\n    <\/div>\n  <\/div>\n\n\n\n<h2 class=\"wp-block-heading\">What is NOT a Foreign Talent Recruitment Program?<\/h2>\n\n\n\n<p>Consistent with Section 10632(d) of the Act, a Foreign Talent Recruitment Program does not include the following international collaboration activities, <strong>so long as the activity is not funded, organized, or managed by an academic institution or a Foreign Talent Recruitment Program on the lists developed under paragraphs (8) and (9) of Section 1286(c) of the John S.
